How will the salaries of conscripts be paid?

 As reported, President Ilham Aliyev signed a decree on partial mobilization in the country. Citizens of the country have been mobilized since the order came into force.

I wonder how the salaries of citizens involved in military mobilization - employees of enterprises, as well as individuals - will be regulated?

Speaking to Qafqazinfo, Sahib Mammadov, Secretary of the Joint Human Rights Group, said that the salaries of everyone involved in the mobilization must be paid:

"It is forbidden to terminate their employment contract during the military assembly, except in cases of liquidation of the enterprise. If the enterprise is liquidated and the two-month conscription period is extended (usually 2-3 months), the heir of the enterprise must pay the person's salary for three months.

The human rights activist noted that if a person who goes to a military meeting falls ill, is wounded in battle, or stays longer than the appointed time, then his salary must be paid:

"This applies to everyone, whether public or private."

Sahib Mammadov added that sometimes there are problems with such issues:

"If any employee of a non-governmental organization is involved in the project, then the NGO does not have the opportunity to pay him a salary. Because the salary fund of NGOs and non-profit organizations has not been formed. He can pay a salary for one or a certain period of time within the project.

Mammadov also clarified the issue of regulating the salaries of individuals involved in military mobilization:

"Individuals have opened shops, pharmacies and employ several employees. When an employee working in these places is mobilized, the store owner will not be able to pay him. There are nuances like this. It would be good if the legislation stipulates that in such cases, if the enterprise or individual is insolvent, the executive power should consider the issue. There is a gap here. The remaining issues are regulated by law.

According to MP Vugar Bayramov, there will be no problem in paying salaries to our citizens and their families, who work in public and private institutions under a salary contract and join the army voluntarily:

"At the same time, I would like to note that we have a large number of compatriots who worked either today or without a formal employment contract. They enlist in the army voluntarily and participate in the protection of territorial integrity. It is very important to support the protection of the social security of the families of these citizens. In this regard, I propose that the list of our citizens who joined the army to liberate our lands voluntarily and partially mobilized be investigated by the Ministry of Labor and Social Protection and the relevant support measures be further expanded. There is a need to intensify measures to provide financial support to the families of our citizens who work today or not.

Fazil Talibov, head of the Public Relations and Communications Department of the MLSPP, said that according to the Labor Code, jobs and salaries are retained when an employee is called up for military service and participates in the army:

"The average salary is calculated from the salary earned by the employee during the two calendar months prior to payment. According to the law on military service, conscripts are protected by keeping their salaries at their permanent place of work for the entire period of their conscription. The employment contract of the said persons may not be terminated until the person returns to work. The employer has the authority to issue relevant orders regarding the regulation of labor relations.
