The donation of property is regulated by a donation agreement, which is a gratuitous deal.
According to Gadin.Net, this was stated by the Chairman of the Board of the Azerbaijan Notary Chamber Huseyn Mammadov during a live broadcast by the Ministry of Justice on the activities of the notary.
According to him, there are several exceptions in this matter.
"There are legal factors that are important for forgiveness. If one of these factors is invalid, the contract may be terminated. Issues such as the will factor and the legality of property are considered here. If the donor consciously expresses his will correctly and there are no restrictions on his ability to act, that person may donate his property to another person as a gratuitous transaction.
However, if there are reasons to invalidate the contract, as well as if the existing facts are confirmed in court, then the contract may be terminated.
At the same time, if both parties agree to voluntarily cancel the pardon, an agreement on cancellation is signed between them. And the property is returned to the previous owner without litigation, "Mammadov said.
