Persons who have been imposed an administrative penalty in the form of public works by the court shall be obliged to carry an electronic means of control in the places where such works are performed and to serve them in order to keep the means in working order.
This is reflected in the law "On Amendments to the Code of Administrative Offenses" signed by President Ilham Aliyev on August 10, Qadin.Net reports quoting publika.az.
According to the law, the executive officer registers persons subject to administrative sanctions in the form of public works, explains to them the rules and conditions of execution of sanctions, provides electronic control to persons subject to administrative sanctions in the form of public works, in accordance with the schedule of public works. Explains what they must carry and use, the rules of service to keep it in working condition, as well as the inadmissibility of any interference or refusal to use electronic means of control and draws up a protocol, the behavior of persons subject to administrative sanctions in the form of public works; supervises the timely arrival to the places where the work is to be performed and leaves those places after the established time, keeps records of the time worked by the persons against whom the administrative penalty in the form of public works has been imposed, twice a month draw up a protocol at least once, when a person has to perform public works, by visiting the places where such works are performed, and take other measures for the implementation of an administrative penalty in the form of public works in accordance with this Code.
The law applies electronic means of control to persons subject to administrative penalties in the form of public works. The rules for the application of electronic means of control shall be established by the relevant executive authority. The control over the performance of the defined duties by the persons to whom the electronic means of control have been applied shall be exercised by the executive officers. Persons to whom electronic means of control have been applied shall be provided with an electronic means of control, and in order to keep the means of operation in working order, the rules of service, inadmissibility of any interference, as well as the legal consequences of this act shall be explained. If the person to whom the electronic control means is applied damages or otherwise renews the means, its value shall be deducted from that person.
At the same time, refusing to carry an electronic control device, damaging it or otherwise rendering it unusable, or failing to service it for an unjustified reason in order to keep it in working order shall be considered as evasion of an administrative penalty.
